Pingstreams Terms of Service

1. Agreement to Terms

Welcome to Pingstreams! These Terms of Service (“Terms”) govern your access to and use of Pingstreams websites, applications, and services (collectively, the “Services”). By using Pingstreams, you agree to these Terms. If you do not agree, do not use the Services.

2. About Pingstreams

Pingstreams is a proprietary, AI-powered omnichannel customer service platform that enables businesses to manage and automate customer interactions across multiple channels. Pingstreams is not open source; the Services are licensed to you under these Terms and not sold.

3. Eligibility

You may use Pingstreams only if you are at least 18 years old and legally able to enter into binding contracts. If you are using Pingstreams on behalf of a company or organization, you represent that you have the authority to bind them to these Terms.

4. Accounts

To access certain features, you must create an account. You agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and all activities under your account.

5. Use of Service

You may use the Services only as permitted by law and these Terms. You agree not to:

• Copy, modify, or reverse-engineer Pingstreams software.
• Use the Services to transmit harmful, unlawful, or infringing content.
• Attempt unauthorized access to the Services or related systems.
• Resell or sublicense Pingstreams without our written consent.

Pingstreams reserves the right to suspend or terminate accounts that violate these Terms.

6. Customer Data

You retain ownership of all data, content, and communications (“Customer Data”) you submit into Pingstreams. You grant Pingstreams a limited license to process, store, and transmit Customer Data only as necessary to provide the Services.

We do not use your Customer Data to train AI models without your explicit consent or contractual agreement.

7. Intellectual Property

All rights, title, and interest in the Services, including software, designs, trademarks, and documentation, are owned by Pingstreams or its licensors. Except for the limited rights granted under these Terms, no rights are transferred to you.

8. Subscription, Fees and Payment

Some features of the Services are provided under paid subscription plans. Fees, billing cycles, and payment methods will be specified at the time of purchase.

You authorize Pingstreams or its payment processors to charge applicable fees. All payments are non-refundable except as required by law or explicitly stated in writing.

9. Free Trials

Pingstreams may offer free trials. Unless you cancel before the trial ends, your subscription may automatically convert to a paid plan and you authorize billing accordingly.

10. Termination

You may terminate your account at any time by contacting support. Pingstreams may suspend or terminate your access if you violate these Terms, fail to pay fees, or cause harm to the Services or other users.

Upon termination, your license to use the Services ends immediately. Some provisions (e.g., intellectual property, liability, and indemnity) will survive termination.

11. Third-Party Services

The Services may integrate with third-party platforms (e.g., CRM, messaging, or payment providers). Your use of those services is subject to their own terms and policies. Pingstreams is not responsible for third-party services.

12. Security

We implement industry-standard measures to protect your data. However, you are responsible for securing your own systems and ensuring safe use of your account credentials.

13. Disclaimer of Warranties

The Services are provided “as is” and “as available.” Pingstreams does not guarantee uninterrupted service, error-free operation, or that the Services will meet your needs. To the maximum extent permitted by law, we disclaim all warranties, express or implied.

14. Limitation of Liability

To the fullest extent permitted by law, Pingstreams will not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, or business opportunities.
• Any damages exceeding the fees you paid to Pingstreams in the 12 months preceding the claim.

15. Indemnification

You agree to indemnify and hold harmless Pingstreams, its affiliates, officers, employees, and partners from any claims, damages, or expenses arising from your use of the Services, your Customer Data, or your violation of these Terms.

16. Modifications

We may update these Terms from time to time. If we make material changes, we will notify you via email or within the Services. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles. Disputes will be resolved in the courts of San Francisco, California, unless otherwise required by law.
