Acceptable Use Policy

1. Introduction

This Acceptable Use Policy ("AUP") governs your use of Pingstreams services, websites, and applications (the "Services"). By accessing or using Pingstreams, you agree to comply with this AUP and our Terms of Service. Violations may result in suspension or termination of your account.

2. Prohibited Activities

You may not use Pingstreams to engage in or facilitate:

A. Illegal Activities

  • Any activity that violates applicable local, state, national, or international law or regulation.
  • Fraud, identity theft, money laundering, or other financial crimes.
  • Distributing, promoting, or facilitating child exploitation material or human trafficking.
  • Sale or distribution of controlled substances, weapons, or other illegal goods.

B. Abuse and Harm

  • Harassment, bullying, stalking, or threatening behavior toward any individual.
  • Content or communications that promote violence, hatred, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
  • Doxxing (publishing private information without consent) or other invasions of privacy.
  • Phishing, social engineering, or impersonation.

C. Spam and Unsolicited Communications

  • Sending unsolicited bulk messages, spam, or commercial advertising without proper consent.
  • Using Pingstreams to operate or participate in email or messaging spam campaigns.
  • Scraping, harvesting, or collecting contact information without authorization.

D. Security Violations

  • Attempting to gain unauthorized access to Pingstreams systems, servers, networks, or other users' accounts.
  • Probing, scanning, or testing vulnerabilities without explicit written permission.
  • Interfering with or disrupting the Services, servers, or networks (including denial-of-service attacks).
  • Distributing malware, viruses, worms, Trojan horses, or other malicious code.
  • Bypassing or attempting to bypass security measures, authentication systems, or rate limits.

E. Intellectual Property Violations

  • Uploading, sharing, or transmitting content that infringes copyright, trademark, patent, trade secret, or other intellectual property rights.
  • Reverse engineering, decompiling, or attempting to extract source code from Pingstreams software (except as permitted by law).
  • Removing or obscuring copyright notices, watermarks, or proprietary markings.

F. Misuse of Services

  • Using Pingstreams in a manner inconsistent with its intended purpose as a customer service and communication platform.
  • Reselling, sublicensing, or redistributing the Services without written authorization from Pingstreams.
  • Creating multiple accounts to evade restrictions or limitations.
  • Using automation, bots, or scripts to abuse features or artificially inflate usage metrics.
  • Exceeding reasonable usage limits or consuming excessive system resources in a manner that degrades service for other users.

G. Inappropriate Content

  • Sexually explicit material, obscenity, or pornography (except where legally permitted and disclosed in your use case).
  • Graphic violence, gore, or content that glorifies harm.
  • Content that promotes self-harm, suicide, or eating disorders.
  • Misleading, deceptive, or fraudulent content.

3. Compliance Obligations

When using Pingstreams, you must:

  • Comply with all applicable laws, regulations, and industry standards (including GDPR, CCPA, CAN-SPAM, TCPA, and similar privacy and communication laws).
  • Obtain proper consent before collecting, processing, or communicating with end users through Pingstreams.
  • Maintain accurate records and honor opt-out or unsubscribe requests.
  • Ensure your use of AI features (e.g., chatbots, automated replies) complies with disclosure requirements and does not mislead users.
  • Not use the Services in any regulated industry (e.g., healthcare, financial services) without ensuring compliance with sector-specific regulations.

4. Reporting Violations

If you become aware of any violation of this AUP by another user, please report it immediately to: abuse@pingstreams.io

We will investigate reported violations and take appropriate action, which may include warning the user, suspending their account, or terminating service.

5. Enforcement

Pingstreams reserves the right to investigate suspected violations of this AUP. We may:

  • Monitor usage patterns and content for compliance purposes.
  • Suspend or restrict access to accounts pending investigation.
  • Remove, block, or disable access to content that violates this AUP.
  • Terminate accounts and refuse future service to violators.
  • Report illegal activity to law enforcement or other authorities.
  • Cooperate with legal investigations and court orders.

Enforcement actions are at Pingstreams' sole discretion. We are not obligated to monitor all user activity but reserve the right to do so to protect our Services, users, and third parties.

6. No Liability for User Content

You are solely responsible for your use of Pingstreams and any content you submit, transmit, or store. Pingstreams does not endorse, verify, or control user content and is not liable for any damages or harm arising from user conduct or content.

7. Changes to This Policy

We may update this AUP from time to time to reflect changes in our Services, legal requirements, or community standards. Material changes will be posted with a revised "Last updated" date. Continued use of Pingstreams after updates constitutes acceptance of the revised AUP.
